The Waller-Herndon Question

Note: The Waller Herndon question finally had an easy answer.  Research on the Wallers of Virginia proved that Col. John Waller’s sister was not Mary Waller who married Edward Herndon because Mary Elizabeth Waller died at age two in Newport Pagnell, Buckinghamshire, England: John Waller, her father, was later interred in the same tomb he commissioned for his daughter.  The Rev. Dr. Cynthia Forde made the decision to include the Wallers in the ancestry of Anne Herndon, probable daughter of Edward Herndon, in response to rumors that never die. This author cannot discount a probability that Edward Herndon married a Waller.

The report will attempt to identify Mary Waller, who married Edward Herndon. Mary is believed to have come from England with her brother, Col. John Waller.  Much has been written about this family, some of which is speculative and lacking documentation. The counties in which the Waller and Herndon families lived were “burned” counties, having lost their records to disasters of men and nature. These include New Kent, Caroline, and King William Counties. This lack of records hampers the study of relationships.

To become oriented to the place and period relevant to these ancestors, Internet searches were made. In Ancestry.com’s World Tree project, no less than 437 postings surfaced for Edward Herndon and Mary Waller. A sampling of these has been included here, showing that Edward lived from about 1678 to 1758 in Virginia. His presumed wife, Mary Waller, is believed to have been born 23 May 1674 in Newport Pagnell, Buckinghamshire, England. Eight children are listed for the couple.[1]The International Genealogical Index (IGI) shows a birth date of Mary Waller, matching that of the World Tree Project. Mary’s parents are believed to be John Waller and Mary Pomfret.[2]

The original parish registers of Newport Pagnell do indeed show that Mary Waller was baptized on that date, probably born a few days or weeks earlier. The priest’s notation tells that she was the “daughter of John” but does not include her mother’s name.[3]The IGI contains a posting concerning the marriage of John Waller to Mary Pomfret, revealing that the marriage took place 13 January 1669 in Walton Parish.[4]These records do show indeed that John Waller and Mrs. Mary Pomfret married in Walton Parish.[5]

It appears that John married a young widow. Because John and Mary were married in 1669, they were likely born sometime in the 1640s. The immigration record showing a Mary Waller coming to America would have occurred when Mary was quite elderly, perhaps eighty years old. The sources for the immigration records, in which Mary Waller’s name appears, tell that these 1723 immigrants were felons, being banished from England. It does not seem likely that this Mary Waller could have been the widow of Dr. John Waller of Newport Pagnell. She could not be traveling with a group of felons, nor at such an advanced age. 

Another point against this Mary being the widow of Dr. John Waller of Newport Pagnell is that Mary’s name appears in the records several years before 1723. In 1720, she received four hundred acres on the south side of the Mattaponi Creek, adjacent to John Waller and Phillip Todd.[6]The actual patent bears the date of 21 February 1720, and patents were often issued a few years after the initial survey and occupation of the land.[7]Dr. John Waller of Newport Pagnell did not die until 1723, so it defies logic that his wife would leave him in his old age to go to America.

A detailed study of the Waller family, “The Wallers of Endfield, King William County, Virginia,” by Andrew Lewis Riffe, gives documented information on the family. Dr. John Waller’s will was written 21 August 1716 and has been abstracted into the report. He named his sons Benjamin, William, Thomas, John, and Edmund, and his daughter, Jemima. No Mary was included in the will either as his wife or his daughter. This strongly suggests that his wife had predeceased him. It also strikes a blow at the theory that Edward Herndon’s wife was Mary Waller, daughter of John Waller. John would have been about seventy years old in 1716. He died in August of 1723.[8]

Riffe’s excellent treatise is careful not to jump to conclusions or to accept any undocumented information as fact. He points out that John Waller Jr., the son of John Waller and Mary Pomfret, had arrived in America by 1696. In May of that year, he had surveyed the 1029 acres in King and Queen County that would become Endfield, his home place. Sixty-five years later, John Waller Jr.’s son, John, brought suit concerning the division of Endfield among John Jr.’s heirs. A plat map was produced, showing lines dividing the land between John Waller, Thomas Waller, Mary Waller, and Benjamin Waller. Mr. Riffe states, “It was Thomas Waller’s and Mary Waller’s portions of this land that John Waller (their father, the original owner) sold to Benjamin Waller.”

This implies that Mary Waller, found mentioned frequently in the land records, was the daughter or married daughter-in-law of John Waller (Col.). Mr. Riffe makes no attempt to identify her further. He does make reference to two articles in Virginia historical magazines, which supposedly give a strong case for Mary Waller being the wife of Edward Herndon. The first comes from the William and Mary College Quarterly. The author of this article, whose name is not shown, asserts that the will of Dr. John Waller of Newport Pagnell contains a phrase that refers to the eldest daughter, Mary, living in Virginia. This is incorrect, as Riffe’s transcription of the will contained no mention of Mary. In fact, the only married daughter in the will was Jemima. The author of this article goes on to show that Mrs. Mary Waller lived near Edward Herndon, providing strong circumstantial evidence that Edward had married her daughter, Mary Waller.[9]These arguments are weak, based on the reasons already given.

Riffe’s treatise also makes reference to The Herndon Family of Virginia by John Goodwin Herndon. This book, part of a multivolume set, was located in the Family History Library’s collection. The author cites the source of the Herndon-Waller marriage to Mr. Moncure D. Conway. The same assumption underlies this theory, that Mrs. Mary Waller, still alive in 1729, was the mother of Mary Waller, born in 1674, and therefore, the wife of Edward Herndon because he lived nearby. The supporting evidence for Mr. Herndon’s assertion is a letter written in 1787 to Joseph Herndon, a grandson of Edward. In the letter, he referred to his cousin, Jack Waller.[10]It seems that by 1787, after two more generations since Edward had come along, there would have been plenty of opportunities for the Herndon and Waller families to intermarry. This bit of evidence seems insufficient to conclude that Edward Herndon had married Mary Waller. Although such may indeed be the case, it seems that hasty judgment may have come into play early on. Once such conclusions get into print, they are circulated and eventually carved into stone. Edward may have married a Waller relative, but nothing has been found to indicate that his wife was named Mary.

In summary, these are the points against the supposition that Edward Herndon’s wife was Mary Waller, daughter of John Waller and Mary Pomfret.

•    Dr. John Waller of England died in 1723. His will did not mention a daughter, Mary, suggesting she could have predeceased him. His will also made no mention of his wife, which would be very peculiar had she still been alive.

•   Dr. John’s wife, Mary Pomfret Waller,  would not leave him before his death, at the age of nearly eighty, and go to America.

•     It is highly unlikely she would still be alive in 1739 at nearly one hundred years of age.

•     No document exists that even gives Edward Herndon’s wife’s first name as Mary.

•     There were several Wallers in the area, and by 1720, a new generation had come to maturity in America. One of these younger Wallers could have left a widow named Mary.

It is very unlikely that any new evidence will be located concerning these families, especially considering that most of the records have been destroyed in the counties where the Wallers lived. Research at this point focuses on the careful interpretation of the existing records, with a skeptical eye toward published genealogies.

Further commentary by Cynthia Forde on the Waller-Herndon question: Dr. John Waller and his wife, Mary Pomfret Waller, did indeed have a daughter named Mary Elizabeth Waller. Dr. John Goodwin Herndon, Fellow, American Society of Genealogists, wrote the definitive Herndon history with the theory that Mary P. Waller moved to America after the death of her husband in 1723. Dr. Herndon located a deed transfer from Edward Herndon to his son adjoining Mrs. Mary Waller’s property.  

A family tradition dating back to the mid-nineteenth century believed this theory to be true. Recent research has raised questions about the family tradition and John G. Herndon’s conclusions suggesting that Mrs. Mary Waller named on the deed was Mary Lewis (Waller), the daughter of Colonel John Waller; the property was given to her by Colonel John. “This is an example of a supposition becoming accepted fact without adequate documentation, even by expert researchers,” according to Melanie Rigney, Brown Book Company editor. “There’s a tendency to believe that, as the famous line from John Ford’s The Man Who Shot Liberty Valance says, ‘When the legend becomes fact, print the legend.’” For this reason, the Waller history was included: Edward Herndon may have married a Waller descendant, although it is certain he did not marry the daughter of Dr. John Waller because  Mary Elizabeth Waller’s death record was located in England.

Historical Chronology

13 January 1669: John Waller marries Mary Pomfret at the Church of St. Michael in Walton Parish, Buckinghamshire, England (Source: The Register of the Parish of Walton in Buckinghamshire 1598–1812; printed privately for the Bucks Parish Register Society by permission of Algernon E. Tollemache, B.A., Rector of Walton, p. 18). It is possible that this was a second marriage for Mary Pomfret.

1671–1684: John and Mary Pomfret Waller settle at Newport Pagnell in Buckinghamshire, located about fifty miles northwest of London. Here they have a family of nine, born over a period of thirteen years.

6 August 1723: Dr. John Waller is buried in a tomb he designed at the Church of Newport Pagnell, Buckinghamshire, England.  He is buried in the tomb of his daughter Mary, ending the rumor that Mary traveled to the colony of Virginia and married Edward Herndon.

Mary Pomfret Waller’s journey to the colony of Virginia after her husband’s death has long been a family legend. A deed exists in Spotsylvania County, Virginia, dated November 1724, that describes the property of Edward Herndon next door to Mrs. Mary Waller. For that reason, early Waller historians concluded Mary Pomfret Waller lived out her days with her son, Colonel John Waller and her daughter, Mary, wife of Edward Herndon.  They have erred.

Priscilla Who?

Researching ancestral females without identifying maiden names has to be one of the greatest challenges to a genealogist. For instance, Priscilla Bankston’s maiden name, her birth date, and her lineage are unknown. We know of her existence from deeds, membership in Mars Hill Baptist Church in 1803, and the estate papers of her husband, Peter Bankston. She married Peter, son of Lawrence and Rebecca Hendricks Bankston, 1750–1754 in North Carolina. There is no death or burial record for Priscilla but we know Peter spent his last years as an invalid and died intestate in Clark County, Georgia. She proved her headright in his estate settlement in January 1804 following his death either late in 1803 or early in 1804.  Because we have the records of that estate inventory we can reach up onto the highest shelf of our imaginations and spend a day with widow Priscilla in April of 1804 following their estate auction.

April 1804:

“Mama!" Wake up, Mama!”  

How long had I slept? It was hard to stay awake through the auctioneer’s droning and intoning.  It gets harder and harder to stay awake these days. I woke up to see Lary handing me another piece of paper to sign.  What does it say, I wanted to know.  How silly that they ask me to sign papers I cannot read. 

“It is an inventory of the estate sale” … he explains gently, laying the paper down on the old pine table Peter made for me so many years ago.  Of course, I sign the paper with my customary “Y” mark and hand it to him for consideration.  

Lifting the paper he reads it aloud to me with gentleness and patience. The sale is now finished and the legal fees will be paid.  The money will be disbursed according to intestate law because Peter did not write a will.  Our children receive two-thirds of the sale proceeds and I receive one-third. Glancing around the room I see the others looking my way anxiously.  It is as though I have become the child and they have become the parents watching me closely, assuring and comforting me. 

 Lary stands at the head of the table nearest me with an inventory I must approve; William, Andrew, and John sit on chairs on the opposite side of the table working on lists the auctioneer handed to them. Nimrod and Judith pour fresh coffee while Jacob and Jemima pass plates of freshly baked peach pie.  Abner entertains the younger children with battle stories of the Revolutionary War while Hiram listens intently from a nearby stool. Nancy bustles about the room with trays of sandwiches making certain that no one is left hungry. 

Peter’s chair is conspicuously empty at the other end of the table. No one sits in Pa’s empty chair.  His chair is the most worn and used looking at all of the pine chairs.  He spent the last years of his life as an invalid, sitting many long hours from daylight to dusk watching the hands out the window if the weather was bad; or if weather permitted the chair was moved to the porch where he could observe the work in progress.  The chair seems far more empty today on this day when our possessions are sold – a lifetime of gathering and collecting – now gone.  

And how should I feel on this day with the empty chair across the table – and most of my possessions and household sold to the highest bidder?  Of course, that is why I sleep.  It is better to let sleep dull my mind and darkness dull the ache in my heart. The ache is ever with me.  Life is too soon over.  What is that passage from Ecclesiastes?  I cannot remember it.  

It seems like only a moment ago I was a young maiden, fair and comely, catching Peter Bankston’s twinkling eye. Was it 1750?  I think so, but my mind plays tricks.  And the years rush past in my mind as I remember the births of nine babies: the daughters, the sons, the pain, the joys they brought into our lives through the turbulence with the British ruling the colonies - ultimately leading to the war that bought our freedom from that bitter tyranny.    

We lost our son Andrew to that war – just as friends and family lost loved ones, too.  We were there in North Carolina when it was first settled about the year 1744; from that time until 1754 or thereabouts, there were very few families in that part of the county, now Caswell County, we Bankston's were among the first settlers along with the Graves, Kimbros, Leas, and Pattersons.  Like the others our goal was to possess fertile land and good pasture: the cane was so plentiful at that time that cattle were fat all thru winter without feeding.  Life was good until the British rule became unbearable.

But despite the heartache of grief and loss after the war, we were giddy with optimism about the future of this new country.  Georgia had land opportunities, too, and so we moved west joining the throng of wagon trains hoping to take advantage of new headright grants to increase our lands.  I think it was about 1784, we settled in northeast Georgia, first Wilkes County, and then Jackson County about 1799; Jackson became Clarke County, Georgia. Here among the flowering trees so glorious in springtime and resplendent in fall foliage is where we have stayed, and our families increased and prospered. This is where Pa died and so shall I.

What shall I do now with my household sold – the Negroes – my beloved possessions?  And then I wonder why do I need them now?  For what purpose must I have them?  Soon – all too soon - I shall follow Peter into the earth and to heaven beyond.  

It is hard to think of the horses and cattle, the cows and calves sold to the highest bidder.  It is too much to bear.  I must have fallen asleep when they were selling the furniture, the beds, and dishes. I could not stay awake when they sold the Negroes: Leanor, her three children, David and his wife, Patience. It is too much for my tired mind to withstand - to think of a life without Tinah and Isham, too, who have been my faithful servants for oh so many years.

It is simply too hard to stay awake and I slip back into the gray mist of sleep.  But Larry and Nancy nudge me once again, “Listen, Mama.   You will keep Isham and Tinah, and we bought Leanor and her three children for you too.  Wake up, Mama.  This is the list of furniture and dishes that we purchased to give back to you.  The old pine table Pa built for you – and the chairs – are yours for the rest of your life, Mama.”  

Köttbullar (Swedish Meatballs)

1 1/2 cups soft bread crumbs, about 3 slices bread

1 Tablespoon dried minced onion or 1/4 cup finely chopped onion

1 1/2 Teaspoons salt

1/4 teaspoon pepper

1/4 Teaspoon nutmeg

3/4 cup milk

2 Pounds ground beef

2 Tablespoons butter or margarine

2 Tablespoons vegetable oil

2 Tablespoons flour

1 Can (10 1/2 ounces) condensed beef broth

1 Cup half-and-half or light cream

Combine bread crumbs, onion, salt, pepper, and 3/4 cup milk in a large mixing bowl.  Add ground beef until well blended; form into balls about 1 to 1 1/2 inches in diameter. 

Brown meatballs in butter and oil in a large skillet; remove with a slotted spoon to a 2 1/2-quart baking dish. Drain off all but 2 tablespoons of drippings; stir flour into drippings.  Cook: stirring constantly until bubbly. Stir in beef broth and cream. Continue cooking, stirring constantly, until sauce thickens and boils for a minute. Pour over Swedish meatballs in baking dish. Bake Swedish meatballs at 325° for 35 to 45 minutes. Serves 6.

The Reunion/Communion of Saints

“Dad died this morning, “ said the low voice on the California end of the phone.  It was early Sunday morning, the first day of November 1977.  The phone call from my mother was anticipated; dad had been in a coma for several weeks.  We were silent for a minute or two until we cried and then said good-bye.   What do you door say when someone you love so much dies, and you have such a hole in your heart knowing you will never see their face again?   I arose and prepared for worship with a heavy heart; I had no idea that the news, and the morning, would be life-transforming. 

Dad was diagnosed with incurable wild oat cell lung cancer mid-January of 1977.  If anyone had time to prepare to die, it was dad, but it’s never long enough to say good-bye.   

Ervin Gelnor Vold was born 7 March 1915 in Worth County, Iowa to Carl Otto and Sithone Turvold Vold.   It was only later in life he learned his name wasn’t spelled Irving, but Ervin.  He was the fifth of six children welcomed into the home of first-generation Norwegian immigrants.    The family spoke only Norwegian, so Ervin had to repeat kindergarten because he couldn’t speak English.  He earned his nick-name Paul from neighbors who delighted watching the small seven-year-old galloping his horse to school, “There goes Paul Revere.”  Growing up with a grandpa named Ole, and a big brother named Ole, it was only natural that friends nicknamed Ervin/Paul, Ole, too.   

Irving/Ervin/Ole/Paul Vold was a well-liked, respected member of Worth County, Iowa. He graduated from high school with the class of 1934.   He loved hunting, fishing, and woodworking.  And he fell in love with my mother, Rose Arlene Miller! 

Rose was the daughter of Coy Clifton Miller and Ruby Anna King.   On 5 September 1937 dad and mom eloped.   On that lovely Sunday afternoon, with friends, Gilmore and Delores Halland, they drove to Cresco, Iowa to be married.  

Rose was born in Northwood, but her parents moved to Texas shortly after her birth; she lived there until her thirty-two-year-old mother passed away leaving twelve-year Rose and two younger sisters.   Rose and her sisters returned to Northwood to live with her maternal grandmother, Anna King Painter.   With a marked southern drawl Rose responded to all adults,  “Yes, Ma’am,“ which frustrated her teachers who considered it highly imprudent,  She graduated at age 17 from the Northwood High School class of 1937; she turned eighteen in June.   

Mom and Dad were described as a cute young couple fully embraced by the Northwood community.  Three daughters were welcomed to the family.  Dad said we looked so much alike at birth we could have been identical triplets.  We were especially alike in our love for dad.

Dad’s first job was working for his step in-law grandfather J.L. Painter; he also worked for Urdahl and Vold grocery store. He joined his father-in-law Coy Miller, working on the railroad as a fireman, in El Paso, Texas, then Tucson, Dunsmuir, California.   He wasn't happy away from Northwood.   Mom and Dad, plus  three-month-old Bonnie and I returned to Iowa in 1942.  Dad bought a tank wagon service to bring fuel oil and gasoline to farmers.  In addition to the fuel business, he did custom cabinetry and remodeling.  Evidence of his fine cabinetry is in many homes and First Lutheran Church in Northwood.  By 1956 he decided propane gas was going to put his fuel transport out of business.  He sold his business and moved the family to Glendale, California.  He worked briefly for Wilson Packing Company, and then the Los Angeles School System as the Air-Conditioning Superintendent.

It is any wonder that dad contracted lung cancer.  Dad was a lifetime cigarette smoker.  Cigarettes, plus, years of inhaling fumes from fuel oil, linoleum glue, varnish, and paint were enough to cause lung cancer; in addition, he worked refinished sister Merrilee's fiberglass motorboat.  The cancer was acute, the wild oat cell was incurably giving him less than a year to live.  He wanted to go home.  Home was always Northwood, the home of his heart; he wanted to say good-bye to friends and family.  He prepared for his death with this important trip to tell the people he loved, just how very much he loved them.  Claire Shaw, his lifelong best friend, told me about the emotional good-bye.  They shared memories through a long night; they and hugged they wept.  He visited me in Elk Horn, Iowa and told me good-bye.  How do you say goodbye, but cry? 

I wanted to say good-bye with a special gift for my parents' fortieth wedding anniversary.  I painted a pastel portrait of our nuclear family, the five of us.  The Northwood Anchor News published the image of the painting as a surprise to my subscriber parents.  I shipped the portrait to them, and I flew to California to say good-bye again.  

Saying good-bye is a forever challenge, whether it was two weeks or a lifetime.  It did not get easier.  While there, my sisters and I took dad for his appointment with a substitute oncologist, his regular doctor was out of town.  The doctor coaxed him to try chemotherapy, promising him “You could be out golfing again!”  Dad didn't golf, but he reluctantly agreed to try the new chemotherapy procedure; he almost died that night.  

 I returned home to five children in Iowa.  It was once again heartbreaking to say good-bye.  My sisters and I visited him in the hospital; but he waved us away saying, “You are taking up my air to breathe,” then he said, “be good to your mother!”  I turned for one last look at dad.  The sunlight from the window cast a beam across his forehead.  His head was bowed, his hands were folded in prayer, and as he struggled to breathe, he prayed out loud. “Our Father Who Art In Heaven, my heart wept, “Good-Bye Dad.”

A few weeks later, the early morning phone call came from mom, dad is gone.  I went to worship.  And my life changed forever.  God called me into ministry during the Apostles Creed with the words, “I believe in the communion of saints" (Latin, communio sanctorum) when referred to persons, is the spiritual union of the members of the Christian Church, the living and the dead).   I grasped the deeper meaning of the Eucharist.   It was a transforming moment. My mind and my heart were opened to the mystical reunion of all who have died in Christ now caught up with Him, and with those of us in the pew as we commune. We are all part of a single “mystical body” with Christ as the head, in which each member contributes to the good of all and shares in the welfare of all. 

 The earliest known use of this term to refer to the belief in a mystical bond uniting both the living and the dead in a confirmed hope and love is by Saint Nicetas of Remesiana (335–414); the term has since then played a central role in formulations of our Christian creed. Belief in the communion of saints is affirmed in the Apostles Creed.   

As my life unfolded, I accepted the call to ordained ministry, to presiding over the Eucharist.  I remain in awe, gripped by the vision of the mystical, incredible reunion/communion of the Saints in every Eucharist, “This is my body given for you; this is my blood shed for you!"  For YOU!  For ME! Amen!

Daughter of the American Revolution

Aunt Betty Miller Francis said she wanted to be a member of the D.A. R., the Daughters of the American Revolution about 1965.  Her tremendous enthusiasm propelled me to do some serious research making aunt Betty’s dream come true thirty-five years later.  I didn’t stop with aunt Betty, but I invited aunt JoAnn Eid to become a member, too.  Now, my daughters and granddaughters are proud members as well.  

My D.A.R. Patriots are Hugh Ivey, his son-in-law, Fadda Jarrett,  James Lea of Country Line Creek, his son-in-law, Capt. Joseph I. Henderson, and his son-in-law, Lawrence Bankston.  I have one more patriot, Peter Bankston, available as a patriot.  Because of the lack of solid evidence required by the D.A.R., there are at least three additional patriots that are mine.

In addition, he was on a tour to Briar Creek from 15 February to 1 April 1779.  He lost a blanket, saddle, and bridle at Briar Creek.  AA. 3523."

Lawrence Bankston:1774   Lawrence Bankston, Jacob, and Andrew Bankston were listed on Lince's Circle in North Carolina with Tunstall Roan, John Poteet, and Joseph Henderson. The year was 1995. My aunt Frances Vold Meyer and I visited Norway for the first time, the home of our ancestors for countless generations.  I was quite excited to track down 95-year-old legendary genealogist, Knud Amundson Gulsvik, in an assisted living facility.  Our cousin, Kolbjorn Skinnes from Flå, Norway, accompanied us to translate, assuring us Knud was elated to meet us.  Knud lived up to his legendary reputation when he recognized the name of our ancestor, Ole Halgrimson from the Vold Gaard, who caught Amerika Fever in 1861 and migrated to build a new life.  Knud was able to tell us stories about my great grandfather because he had memorized all of the ancestral members of the Flå parish.  

Knud’s genealogy was framed on display filling the long wall of his room.  He had traced the ancestry of the Flå community to the early chieftains and kings of Norway.  The flow chart was mounted on blueprint paper that was about sixteen feet long by five feet high.  Knud pointed to the Volds and Gandrud’s on the map, tracking the converging lines back to those early chiefs and kings.  

But was it true? Many historians discount Knud’s research as fiction.  Some of his early sources were the Icelandic Sagas based on legend.  He spent his life delving into the earliest and most primitive records in all of Norway for his discoveries. But there is this truth: in ancient times, when Norwegians did not read or write, they memorized their lineage. To know one’s family for six past generations gave one clout with the king; it was called a Hauld. 

Thanks to Knud Amundson, I have his chart for my family on my computer dating back to such marvelous legendary names, Sigurd the Worm-Eater, Olav Tree-Hewer, Halvdan the Black, Snorre Snede!  Is it a legend?  At least I have clout with the king, for I have many Haulds!
